I used “first step towards their freedom” for a reason in the above sentence. We live in a society where conservativeness is at its peak. And to scrap down section 377 is only the beginning in the right direction with lots to achieve before tasting the final drink of freedom for this community.
Though SC made clear that it is utmost important to upheld the Constitutional morality in India by observing that equality before law cannot be denied by giving precedence to public or religious morality.
Though the judgement goes a long way to remove the stigma from the society, it is to be noted that lot more effort is needed if we really want to bring in equality in terms of equal protection of laws for everyone, equal opportunities for them in jobs, equal remuneration and pay, and above all the awareness to remove the stigma from this society towards the community.
An anti-discrimination law at this point of time is much needed to cater the needs of this community so as to ensure that they are not discriminated in any aspect. Central and the State governments have to work in congruence so as to make sure this community receives education, work and the equal wellbeing.
Apart from government, civil society has to work for them so as to see that the law is abided and persons from this community receive education and their health has also been taken care off.
Above all, if we have to look for their freedom, it is of utmost importance that we all rise above the conservative mindset and accept that they too are a part of this society as a whole.
